You would support that for non-incubating projects??? ;o)

Isn't it so that the release and distribution criteria should be the same 
whether you are incubating or not, with only the additional requirement of 
incubating projects;

 * Incubation disclaimer.

From the "general pool of requirements", that are somewhat more under the 
microscope for incubating projects, would be things like "No known licensing, 
IP and trademark issues.", but it stills applies across the board.

IMHO, I think it is fairly important for incubating projects to be "the real 
deal" as close as possible, especially for TLP aspiring projects that does 
not consists of seasoned ASF veterans, as the day will come when these issues 
will come up.
That raises the question whether the Incubator is a "school in community", and 
if so, whether all aspects of a running the TLP must have happened during 
Incubation and/or the Incubation Mentor(s) staying with the project long 
after graduation to ensure that all this procedures are executed correctly.
